Can You Fly on Planes with Delta-8

When you’re traveling with cannabis, you do have to be mindful because each state has different rules, and the rules within different locations change from time to time. You might be able to fly with delta-8 if you’re traveling to places that do allow this.

The Legalities of Flying with this

Delta-8 is technically psychoactive and in small amounts, it can help you with a lot of things. It is similar in essence to delta-9 in most cases, but it’s less potent, and the quantity is much smaller. Right now, since it is derived from hemp, it’s legit to have, and it’s something that does contain less than .3% delta 9, so it does fly. But, the TSA has updated that it can travel with you to other places that allow this. It also allows them to travel with stuff that has less than .3% THC in it.

Right now, the legality does vary based on the states. The following states don’t allow delta 8:

  • Arizona
  • Alaska
  • Delaware
  • Colorado
  • Mississippi
  • Idaho
  • New York
  • Nevada
  • North Dakota
  • Montana
  • Vermont
  • Oregon
  • Utah
  • Rhode Island

Right now, delta-8 is currently considered legal in the other states, but it is a lot more tightly regulated in some states than other ones. The legality of this does depend on where you’re going, and where the destination is.  You’ll be able to bring it through security in your bag, but you can’t use this within the airport though.

Another thing to consider as well is the airline that you do fly on. Some airlines won’t allow it, so make sure that you check to make sure that the airline is okay with it before you pack away those delta-8 gummies that you went to take. You should bring some documentation that you have purchased this, so that TSA knows that it meets the federal regulations that are there.

Types allowed on Plane

Regardless of the type of delta-8 that you bring, you’re not allowed to exceed .3% when you’re flying. It’s important that you get this from a source that’s reliable, and make sure that it’s fully derived from hemp. You can bring edibles, gummies, liquids, and oils, provided that the storage is correct. This does need to be stored in packaging that’s sealed, not only to prevent it from being leaked, and it can be good for identifying it if the TSA agent is concerned.

You should make sure that it stays within the packaging, not using it when flying, and make sure to check with the airline before you fly. Edibles can be left in carry-ons, or the bag that you check. Vapes are supposed to be packed by having the cartridge within the carry-on, and you should make sure that you have it easy to see. As for liquids, you can store these in the carry-on, and if you do, make sure that it’s only the size of a quart, that holds less than 100 mL of liquid.  You can store these in checked bags.

As for international traveling, it’s best to avoid doing it, because this can be stricter in terms of border control, and the big thing to understand is that both cannabis and hemp are illegal in a lot of places, so technically, if you carry this, it can be bad. It’s best not to take this on any flights internationally, especially if you’re not totally sure of the repercussions that come with this, and what may happen with this as well.
